1. Acceptance of Terms

Welcome to Dreamin! These Terms of Service ('Terms') constitute a legally binding agreement between you and Dreamin ('we', 'us', 'our') governing your use of the Dreamin mobile application ('the App'). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App. We reserve the right to modify these Terms at any time. Material changes will be communicated via in-app notification or email. Your continued use after changes constitutes acceptance of the updated Terms.

2. Eligibility and Age Requirements

You must be at least 13 years old to use Dreamin. If you are under 18 (or the age of majority in your jurisdiction), you must have parental or guardian consent to use the App. By using the App, you represent and warrant that: 1. You are at least 13 years old. 2. You have the legal capacity to enter into these Terms. 3. You will comply with all applicable laws and regulations. We reserve the right to suspend or terminate accounts that violate age requirements.

3. Service Description

Dreamin provides the following services: 1. Dream Journal: A private, encrypted space to record and organize your dreams. 2. AI-Powered Dream Analysis: Analysis of your dreams using OpenAI's GPT models, providing symbolic and psychological interpretations. 3. Dream Visualization: AI-generated images based on your dream descriptions using FAL.ai technology. 4. Dream Animation: AI-generated short videos bringing your dreams to visual life. 5. Statistics and Insights: Analytics about your dream patterns, emotions, and recurring themes. All AI-generated content is for entertainment and self-reflection purposes only. The App does not provide medical, psychological, therapeutic, or professional advice.

4. User Accounts and Security

Account Creation: 1. You must provide a valid email address to create an account. 2. You are responsible for maintaining the confidentiality of your account credentials. 3. You must notify us immediately of any unauthorized access to your account. 4. You are responsible for all activities that occur under your account. Account Security: 1. Use a strong, unique password for your account. 2. Do not share your account credentials with others. 3. Enable two-factor authentication if available. We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.

5. Subscriptions, Billing, and Payments

Free Tier: The App offers limited free features, including basic dream journaling and limited AI analyses. Premium Subscriptions: Premium tiers unlock unlimited AI analyses, unlimited image/video generation, and advanced statistics. Pricing and Payment: 1. Subscription prices are displayed in the App and may vary by region. 2. Payments are processed through Apple App Store or Google Play Store. 3. All fees are non-refundable except as expressly stated in these Terms. Free Trial: 1. New users may be eligible for a 7-day free trial of premium features. 2. You will be charged automatically at the end of the trial period unless you cancel before the trial ends. 3. Only one free trial per user account. Auto-Renewal: 1. Subscriptions automatically renew at the end of each billing period (monthly/yearly). 2. You will be charged 24 hours before the renewal date. 3. You can cancel auto-renewal at any time in your App Store/Play Store account settings. Cancellation: 1. You can cancel your subscription at any time through your App Store or Play Store account. 2. Cancellation takes effect at the end of the current billing period. 3. No partial refunds for unused portions of a subscription period. Refund Policy: 1. Refunds are handled by Apple App Store or Google Play Store according to their refund policies. 2. For technical issues preventing use of the service, contact us at info@getdreamin.app within 14 days of purchase. 3. Refunds are granted at our sole discretion and may require verification of technical issues.

6. Acceptable Use Policy

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to: 1. Abuse or Overload Services: - Exceed rate limits (currently 10 AI analyses per hour for authenticated users). - Use automated tools or scripts to access the App. - Attempt to circumvent usage limitations. 2. Prohibited Content: - Upload illegal, harmful, threatening, abusive, or obscene content. - Upload content that violates intellectual property rights. - Upload content promoting violence, hate speech, or discrimination. - Upload sexually explicit content involving minors. 3. Security Violations: - Attempt to gain unauthorized access to our systems or other users' accounts. - Interfere with or disrupt the App's functionality. - Reverse engineer, decompile, or disassemble the App. 4. Misuse of AI Services: - Use the AI analysis or generation features for purposes other than personal dream interpretation. - Attempt to extract, replicate, or repurpose our AI models. Violation of this policy may result in immediate suspension or termination of your account and, where applicable, legal action.

7. Intellectual Property Rights

Your Content: 1. You retain all ownership rights to your dream content (text, recordings, etc.). 2. By using the App, you grant us a limited, non-exclusive license to process your content to provide our services (AI analysis, visualization). 3. This license terminates when you delete your content or account. Generated Content: 1. AI-generated images and videos created from your dreams belong to you. 2. We do not claim ownership of AI-generated content based on your dreams. 3. You may use generated content for personal, non-commercial purposes. Our Intellectual Property: 1. The App, including its design, features, code, logos, and trademarks, is owned by Dreamin and protected by copyright and intellectual property laws. 2. You may not copy, modify, distribute, or create derivative works from the App without our written permission. 3. 'Dreamin' and related logos are our trademarks and may not be used without permission.

8. Third-Party Services

The App integrates with the following third-party services: 1. OpenAI: For AI-powered dream analysis. Subject to OpenAI's Terms of Use and Privacy Policy. 2. FAL.ai: For AI image and video generation. Subject to FAL.ai's Terms and Privacy Policy. 3. Supabase: For data storage and authentication. Subject to Supabase's Terms and Privacy Policy. 4. Adapty: For subscription management and payment processing. We are not responsible for the availability, accuracy, or content of these third-party services. Your use of third-party services is at your own risk.

9. Disclaimers and Limitations of Liability

Service 'As Is': THE APP IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. No Professional Advice: 1. Dreamin is for entertainment and self-reflection purposes only. 2. AI-generated dream interpretations are NOT medical, psychological, therapeutic, or professional advice. 3. Do not rely on the App for diagnosis, treatment, or professional guidance. 4. If you have mental health concerns, consult a qualified healthcare professional. Accuracy: We do not guarantee the accuracy, completeness, or reliability of AI-generated content. Dream interpretations may vary and should not be taken as factual. Availability: We do not guarantee uninterrupted or error-free access to the App. We may suspend or discontinue services for maintenance, updates, or other reasons. Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination and Account Deletion

Termination by You: 1. You may delete your account at any time through the App settings. 2. Upon deletion, all your personal data (dreams, generated content, account information) will be permanently deleted within 24 hours. 3. Deleted data cannot be recovered. Termination by Us: We reserve the right to suspend or terminate your account at our sole discretion if: 1. You violate these Terms or our Privacy Policy. 2. You engage in fraudulent, abusive, or illegal activity. 3. Your account has been inactive for an extended period. 4. We discontinue the App (with 30 days' notice). Effect of Termination: 1. Your access to the App will be revoked. 2. All your data will be deleted as described in our Privacy Policy. 3. Subscription fees are non-refundable upon termination for Terms violations.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Dispute Resolution: 1. For any disputes arising from these Terms or the App, you agree to first contact us at info@getdreamin.app to seek informal resolution. 2. If informal resolution fails, disputes will be resolved through binding arbitration or small claims court (at your option). 3. You waive the right to participate in class-action lawsuits. For EU/EEA users: You have the right to bring disputes before the competent court in your country of residence.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by: 1. Updating the 'Last Updated' date. 2. Sending an in-app notification or email for significant changes. Your continued use of the App after changes become effective constitutes acceptance of the updated Terms. If you do not agree to changes, you must stop using the App and delete your account.
